User Agreement

This User Agreement ("Agreement") is a legally binding contract between you ("User," "you," or "your") and mylnk ("mylnk," "Company," "we," "us," or "our") that governs your registration for, access to, and use of the mylnk platform, including all associated applications, features, content, and services (collectively, the "Platform").

1. Definitions

For the purposes of this Agreement:

• "Account" means the registered user account you create to access the Platform.
• "Contact Data" means information about third-party individuals that you input, import, or store within the Platform, including names, email addresses, organizations, roles, notes, and tags.
• "Content" or "User Content" means all data, text, files, images, video, audio, messages, contacts, documents, and other materials you submit, upload, or transmit through the Platform.
• "Institution" means a university, college, or other educational organization that has an institutional relationship with mylnk.
• "AI Features" means functionality within the Platform that uses artificial intelligence to generate content, provide recommendations, or automate tasks.
• "Third-Party Services" means external services you connect to the Platform, including Google Workspace services (Gmail, Calendar, Contacts) and LinkedIn.
• "Platform Data" means analytics, insights, aggregated statistics, and derived data generated by the Platform based on your usage and User Content.

2. Eligibility and Registration

2.1 Age Requirement

You must be at least 16 years of age to create an Account and use the Platform. If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and agrees to this Agreement on your behalf.

2.2 Registration Requirements

To register for an Account, you must:

• Authenticate using Google Sign-In;
• Provide your real full name;
• Select a unique username;
• Identify your educational institution or organization;
• Select your role (Student or Admin);
• Set your timezone.

You represent and warrant that all information provided during registration is accurate, current, and complete, and you agree to update such information to maintain its accuracy.

2.3 One Account Per Person

Each individual may maintain only one Account. Creating multiple accounts, sharing accounts, or transferring your Account to another person is prohibited.

2.4 Institutional Affiliation

If you register as a member of an educational institution, you represent that you are genuinely affiliated with that institution (as a student, faculty member, staff, or administrator). We reserve the right to verify institutional affiliations and to suspend accounts associated with false claims.

3. Scope of the Platform

mylnk provides the following core capabilities to registered users:

Networking Preparation	Call prep, research tools, practice features, and follow-up management
AI Assistant	Conversational AI, automated drafting, news debriefs, contact summaries, and smart recommendations
News & Insights	Personalized industry news feed with AI-generated analysis delivered at scheduled times
Analytics & Goals	Activity tracking, engagement metrics, goal setting, and progress monitoring
Document Sharing	Upload and share documents, resumes, and files with other users

The availability of specific features may vary based on your subscription plan, role, and institutional access. We reserve the right to add, modify, or remove features at any time.

4. User Obligations and Responsibilities

4.1 Lawful Use

You agree to use the Platform only for lawful purposes related to professional networking, career development, and relationship management. You will comply with all applicable local, state, national, and international laws and regulations.

4.2 Accuracy of Information

You are responsible for the accuracy of all information you provide to the Platform, including your profile information, contact data, and any content you create or upload.

4.4 Respect for Others

You agree to interact respectfully with other users of the Platform, including through messaging and chat request features. Harassment, bullying, threats, discrimination, or any form of abusive behavior is strictly prohibited.

4.5 Security Responsibility

You are responsible for the security of your Account and any activity that occurs through it. You must immediately notify us at support@milnk.app if you suspect unauthorized access to your Account.

5. Data Handling and Privacy

5.1 Privacy Policy

Your personal information is collected, used, and shared in accordance with our Privacy Policy, which is incorporated into this Agreement by reference.

5.2 Data You Provide

By using the Platform, you consent to the collection and processing of:

• Account and profile information;
• Academic and career-related information;
• Contact data you input or import;
• Messages and communications within the Platform;
• Files, documents, and media you upload (including resumes and video recordings);
• Usage data and interaction patterns;
• Data from connected Third-Party Services.

5.3 Data Processing for AI Features

When you use AI Features, relevant portions of your data (including prompts, contact information, career details, and conversation context) are processed by our AI service provider (Google Gemini) to generate responses. This processing is performed solely to deliver the requested AI feature. Your data is not used to train general-purpose AI models.

5.4 Data Portability

You have the right to request an export of your data in a commonly used, machine-readable format. To request data export, please contact us at support@milnk.app.

5.5 Data Deletion

You may request deletion of your Account and associated data at any time. Upon receiving your request, we will delete your personal information within 90 days, subject to any legal retention requirements. Some information may persist in backup systems for a limited additional period.

6. Platform Integrations and Permissions

6.1 Google Workspace Integration

By connecting your Google account, you authorize mylnk to access:

• Google Sign-In: Your name, email address, and profile image for authentication.
• Gmail (if enabled): Email metadata (subject, sender, recipient, date) for contact enrichment and analytics. We do not access the full body content of your emails.
• Google Calendar (if enabled): Calendar events for synchronization with your mylnk calendar.
• Google Contacts/People API (if enabled): Contact information for import into your mylnk contacts.

You may revoke any of these permissions at any time by disconnecting the integration in your Account settings or through your Google account security settings.

6.2 Google API Compliance

mylnk's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Specifically:

• We only use Google data to provide and improve the user-facing features you see in the Platform;
• We do not transfer Google data to third parties except as necessary to provide Platform features, comply with law, or as part of a merger/acquisition (with user consent);
• We do not use Google data for advertising purposes;
• We do not allow humans to read your Google data except with your affirmative consent, for security purposes, to comply with law, or when aggregated/anonymized for internal operations;
• We do not use Google Workspace API data to develop, improve, or train generalized AI and/or ML models.

6.3 Other Integrations

Additional integrations (such as LinkedIn) may be offered in the future. Each integration will be subject to its own authorization flow, and you will be informed of the specific permissions requested before granting access.

7. AI-Powered Features

7.1 Nature of AI Services

The Platform offers AI-powered features for productivity and career preparation assistance. These features include:

• AI Chat: Conversational AI for career-related questions and guidance
• Quick Actions: Automated drafting of emails, text messages, LinkedIn messages, and call briefs
• News Debriefs: AI-generated summaries of industry news at scheduled intervals
• Contact Summaries: AI-generated profiles of your networking contacts
• Interview Prep: AI-generated interview questions from job descriptions
• Pipeline Classification: Automated categorization of emails and events

7.2 AI Disclaimers

7.3 Prohibited AI Uses

You agree not to use AI Features to:

• Generate content that is harassing, threatening, defamatory, or discriminatory;
• Create misleading or deceptive communications;
• Impersonate any person or entity;
• Generate content that violates any law or regulation;
• Attempt to extract the AI model's training data or underlying systems;
• Circumvent content safety measures or guidelines.

8. Messaging and Communication

8.1 Direct Messaging

The Platform provides direct messaging features between registered users. Messages may include text and media attachments.

8.2 Chat Requests

You may receive chat requests from other users. You can adjust your privacy settings to limit incoming chat requests (for example, restricting requests to users from the same institution). You are not obligated to accept any chat request.

8.3 Message Retention

Messages are stored on the Platform for as long as the participating users maintain active accounts. When a user deletes their Account, their messages may be retained in anonymized form or deleted, in accordance with our Privacy Policy.

8.4 No Monitoring Obligation

While we reserve the right to review messages to enforce these terms and applicable law, we do not proactively monitor the content of private messages between users.

9. Video Recording and Media

9.1 Mock Interview Recordings

The Platform allows you to record video responses during mock interview practice sessions. By using this feature, you acknowledge that:

• Video recordings are stored securely on our servers (Firebase Storage);
• Recordings are private by default and visible only to you;
• If you choose to share a recording (for example, for feedback), it becomes accessible to the recipients you designate;
• You may delete any recording at any time;
• We do not use your video recordings for any purpose other than providing the Platform features you have requested.

9.2 Consent for Recording

By using the video recording feature, you consent to the recording and storage of your video and audio. You represent that you are in a location and circumstance where recording yourself is legal and appropriate.

10. Institutional Users and Administrators

10.1 Institutional Accounts

Educational institutions may partner with mylnk to provide Platform access to their students, faculty, and staff. If you access the Platform through an institutional arrangement:

• Your institution may have designated administrators who can manage certain aspects of institutional accounts;
• Administrators may have access to aggregated usage data and certain account information;
• Your use may be subject to additional institutional policies;
• The institution may be a party to a separate agreement with mylnk that governs data processing for institutional users.

10.2 Administrator Responsibilities

If you are designated as an Administrator, you agree to:

• Use administrator privileges responsibly and in accordance with your institution's policies;
• Protect the privacy of student and user data;
• Not access individual user data beyond what is authorized by institutional policy and this Agreement;
• Comply with applicable student privacy laws, including FERPA.

11. Content Ownership and Licenses

11.1 Your Content

You retain all rights, title, and interest in your User Content. mylnk does not claim ownership of any data, contacts, messages, documents, recordings, or other content you create or upload.

11.2 License to mylnk

You grant mylnk a limited, non-exclusive, worldwide, royalty-free license to use, store, reproduce, modify, and display your User Content solely to:

• Provide, maintain, and improve the Platform;
• Deliver features you request (including AI processing);
• Generate analytics and insights for your dashboard;
• Provide customer support.

This license terminates when you delete the applicable User Content or your Account, except where retention is required for legal compliance or the data has been incorporated into aggregated/de-identified datasets.

11.3 mylnk's Content

All Platform software, design, branding, documentation, and proprietary content are owned by mylnk and protected by applicable intellectual property laws. You receive no ownership interest in mylnk's intellectual property through this Agreement.

12. Acceptable Use Policy

You agree to the following acceptable use standards:

12.1 You Will:

• Use the Platform for legitimate professional networking and career development purposes;
• Provide accurate information about yourself;
• Respect the intellectual property rights of others;
• Keep your Account credentials secure;
• Report security vulnerabilities responsibly to support@milnk.app;
• Comply with all applicable laws and regulations.

12.2 You Will Not:

• Use the Platform for any illegal or unauthorized purpose;
• Harass, abuse, stalk, threaten, or intimidate other users;
• Upload malicious code, viruses, or harmful material;
• Attempt to access accounts or data belonging to other users;
• Use automated tools to scrape, mine, or extract data from the Platform;
• Send unsolicited messages, spam, or commercial solicitations;
• Misrepresent your identity, institution, or qualifications;
• Use the Platform to discriminate against individuals based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic;
• Interfere with the Platform's operation, security, or availability;
• Resell, sublicense, or commercially exploit access to the Platform;
• Use the Platform to create a competing product or service;
• Circumvent any access controls, rate limits, or security measures.

13. Service Availability and Support

13.1 Availability

We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

13.2 Scheduled Maintenance

We will make reasonable efforts to provide advance notice of planned maintenance that may affect Platform availability.

13.3 Support

We provide customer support through email and in-app channels. Response times may vary based on the nature and severity of the issue and your subscription plan.

13.4 Updates and Changes

We continuously improve the Platform and may release updates, new features, or changes at any time. We are not obligated to maintain, support, or offer any particular feature indefinitely.

14. Payment Terms

14.1 Free Tier

mylnk may offer a free tier with limited features. Access to the free tier is subject to this Agreement and may be modified or discontinued at our discretion.

14.2 Paid Subscriptions

Premium features may require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your selected plan;
• Provide accurate and current billing information;
• Authorize recurring charges for subscription renewals;
• Review the specific terms and pricing disclosed at the time of purchase.

14.3 Refunds

Subscription fees are generally non-refundable. Refund requests may be considered on a case-by-case basis at our sole discretion. To request a refund, contact support@milnk.app.

15. Account Management

15.1 Profile Updates

You may update your profile information, privacy settings, and notification preferences through your Account settings at any time.

15.2 Account Deactivation

You may request temporary deactivation of your Account. While deactivated, your data is retained but your profile and content are not visible to other users.

15.3 Account Deletion

You may request permanent deletion of your Account and associated data at any time by: (1) opening Profile in the app and tapping "Delete my account" (which opens our deletion request page), (2) visiting our Request Account & Data Deletion page, or (3) emailing support@milnk.app with "Account deletion request" and your account email. Account deletion is irreversible. Upon processing your request:

• Your profile, contacts, messages, recordings, block list, report data, and other content will be permanently deleted;
• Connected Third-Party Services will be disconnected;
• Active subscriptions will be cancelled;
• Data deletion will be completed within 90 days, subject to legal retention requirements (see the deletion page for details).

16. Termination and Suspension

16.1 Suspension

We may suspend your Account temporarily if we reasonably believe:

• You have violated this Agreement or any applicable policy;
• Your Account has been compromised;
• Continued use poses a risk to other users or the Platform;
• We are required to do so by law.

During suspension, you will not be able to access the Platform. We will make reasonable efforts to notify you of the suspension and the reason, unless prohibited by law.

16.2 Termination

We may terminate your Account permanently for severe or repeated violations of this Agreement. Users who receive a sufficient number of reports from other users (e.g., three or more) for harassment, spam, or other violations may have their accounts terminated automatically. Termination may occur without prior notice in cases involving illegal activity, security threats, or harassment.

16.3 Effect of Termination

Upon termination, the following sections survive: Content Ownership and Licenses, Disclaimers and Limitation of Liability, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive.

17. Disclaimers and Limitation of Liability

17.1 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYLNK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

17.2 Specific Disclaimers

Without limiting the above, mylnk specifically disclaims any warranty or representation that:

• The Platform will meet your specific requirements or expectations;
• The Platform will be available without interruption or error;
• AI-generated content will be accurate, complete, or reliable;
• News articles or industry insights will be timely or comprehensive;
• Mock interview preparation will guarantee success in actual interviews;
• Contact management features will ensure the accuracy of your professional relationships;
• Third-party integrations will function without interruption.

17.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYLNK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, HOWEVER CAUSED, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF MYLNK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MYLNK'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO MYLNK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100).

18. Indemnification

You agree to indemnify, defend, and hold harmless mylnk and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Platform;
• Your User Content, including Contact Data;
• Your violation of this Agreement;
• Your violation of any applicable law or third-party rights;
• Your use of AI-generated content;
• Disputes between you and other users.

19. Dispute Resolution

19.1 Governing Law

This Agreement shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

19.2 Informal Resolution

Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes informally. You may contact us at support@milnk.app, and we will make good-faith efforts to resolve the matter within 60 days.

19.3 Binding Arbitration

If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted individually, and you waive any right to participate in class-wide proceedings.

19.4 Small Claims Exception

Either party may bring qualifying claims in small claims court in the State of Delaware.

19.5 Injunctive Relief

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

20. Changes to This Agreement

We may modify this Agreement from time to time. When we make material changes:

• We will update the "Last Updated" date;
• We will notify you via email or in-app notification at least 30 days before the changes take effect;
• We may require you to review and re-accept the updated Agreement.

If you do not agree to the updated Agreement, you must stop using the Platform and may delete your Account. Continued use of the Platform after the effective date of changes constitutes acceptance.

21. Miscellaneous

21.1 Entire Agreement

This Agreement, together with the Terms of Service, Terms of Use, and Privacy Policy, constitutes the entire agreement between you and mylnk and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.

21.2 Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

21.3 No Waiver

Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.

21.4 Assignment

You may not assign or transfer this Agreement or any rights hereunder without our prior written consent. mylnk may assign this Agreement without restriction in connection with a merger, acquisition, or sale of assets.

21.5 Force Majeure

Neither party shall be liable for any delay or failure in performance due to causes beyond its reasonable control, including natural disasters, pandemics, war, terrorism, labor disputes, government actions, power or Internet failures, or acts of third parties.

21.6 Headings

Section headings are for convenience only and shall not affect the interpretation of this Agreement.

21.7 Electronic Communications

By creating an Account, you consent to receive communications from us electronically, including via email and in-app notifications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
